Can I keep a Gopher Tortoise?

Gopher tortoises have a huge territory and a very strong homing instinct. It may stay in your yard for a while, but unless your fence is buried... let me think here... don't feel like pulling out one of the books right now, but if I'm remembering correctly, gopher tortoises can burrow up to 6 feet deep (if not more) so if it wants out, it will get out. Put it back in the area it was in, it knows where it was going and if you put it somewhere outside of it's home territory it will just try to make it back home, increasing it's risks of being hit by a car. It doesn't need your help with food, it knows everything that it can eat and that is healthy for it... the best thing you can do is just leave it be.
